Welcome to mycrocement.com. This website and its underlying digital assets are owned by an affiliated asset holding company (“Holding LLC”) and are operated under commercial license by DIY Elevated LLC (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of mycrocement.com, including all content, e-commerce functionality, order fulfillment, technical documentation, and purchases of MyCROCEMENT™ products, primers, sealants, mesh, and application tools.
By visiting our website or purchasing materials from us, you engage in our “Service” and agree to be bound by the following terms and conditions. Please read these Terms carefully before accessing our store or placing an order.
1. Scope of Agreement, Digital Ownership, & E-Commerce Hosting
- Applicability: These Terms apply to all visitors, buyers, contractors, trade accounts, and DIY consumers accessing mycrocement.com or purchasing materials from DIY Elevated LLC.
- Material Distributor Status: DIY Elevated LLC is a specialized nationwide distributor of ready-to-use MyCROCEMENT™ microcement systems and protective surface coatings. DIY Elevated LLC is an operational material supplier only and does not act as a licensed building contractor, structural engineer, or installation contractor.
- Digital Asset & Domain Ownership: The mycrocement.com domain name, website design, branding, graphic media, digital assets, and hosting accounts are the exclusive property of the Holding LLC and are licensed to DIY Elevated LLC for store administration and sales fulfillment.
- Shopify Platform Hosting: Our online store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell MyCROCEMENT™ products and services to you. By accessing mycrocement.com, you acknowledge that your transaction data and personal information are processed and stored through Shopify’s infrastructure in accordance with PCI-DSS compliance standards.
- Modifications: We reserve the right to update, change, or replace any part of these Terms by posting updates to mycrocement.com. It is your responsibility to check this page periodically for changes.
2. Product Shelf Life, Storage Conditions, & Expiration Disclaimer
A. Shelf Life & Expiration
All unopened, ready-to-use premixed microcement products, primers, and topcoats possess a strictly enforced shelf life of twelve (12) months from the date of manufacture printed on the container label.
B. Mandatory Storage Conditions
To maintain material stability, product integrity, and proper curing performance, all products must be stored under the following mandatory environmental conditions:
- Temperature Range: Keep containers tightly closed in a dry, climate-controlled environment between 50°F (10°C) and 85°F (29°C).
- Freeze Warning:PROTECT FROM FREEZING. Exposure to sub-freezing temperatures (below 32°F / 0°C) will permanently damage the polymer emulsion, causing irreversible separation, coagulation, and product failure.
- Direct Exposure: Keep products away from direct sunlight, radiant heat sources, open flame, and ambient precipitation. Containers should remain elevated off concrete floor slabs to prevent thermal transfer.
- Container Seal: Once opened, factory seal integrity is compromised. Any remaining product must have the rim cleaned thoroughly, the inner lid secured airtight, and be utilized within 30 days.
C. Limitation of Liability & Storage Warranty Disclaimer
The distributor and manufacturer explicitly disclaim all express or implied warranties, performance guarantees, and product replacement claims for materials that:
- Are applied or stored past the 12-month manufacture expiration date.
- Suffer physical or chemical degradation due to failure to maintain required storage temperatures (including frost/freeze damage or heat degradation).
- Experience contamination, skinning, or hardening as a result of improper container resealing or post-opening storage.
The customer assumes full financial and operational responsibility for verifying batch manufacture dates and inspecting product consistency prior to application.
3. Intellectual Property, Trademarks, & Licensing
All content, trade names, registered and unregistered trademarks, service marks, logos, technical documents, product formulations, media, domain names, and brand assets on mycrocement.com—including but not limited to the MyCROCEMENT™ mark, logo, trade dress, and visual identity—are the sole and exclusive intellectual property of the Holding LLC.
- No Grant of License: Nothing contained on mycrocement.com or in these Terms grants any user, buyer, contractor, or third party any ownership right, title, license, or interest in or to any MyCROCEMENT™ trademark, domain name, or intellectual property asset owned by the Holding LLC.
- Prohibited Use: You may not use, reproduce, modify, distribute, display, perform, or reverse-engineer any MyCROCEMENT™ trademarks, product formulas, imagery, or website content without prior express written authorization from the Holding LLC and DIY Elevated LLC. Unauthorized use of these marks or digital assets violates federal and state trademark, copyright, and unfair competition laws.
4. Product Characteristics, Color Batches, & Technical Disclaimers
MyCROCEMENT™, mineral coatings, and water-based topcoats are technical architectural materials. By purchasing our products, you acknowledge and accept the following inherent material characteristics:
- Natural & Pigmentation Variations: MyCROCEMENT™ and mineral coatings exhibit subtle tonal variations, movement, and textured nuances once applied and sealed. Digital swatch displays on mycrocement.com, photos, and printed color cards are representative samples only. Final cured colors may vary based on application technique, trowel burnishing, lighting conditions, coat thickness, and substrate porosity.
- Batch Consistency: While factory formulations strictly adhere to pigmentation standards, slight batch-to-batch shade variances can occur. Customers are strongly advised to purchase sufficient material for an entire project in a single order to ensure maximum batch uniformity.
- Ready-To-Use Formulations: MyCROCEMENT™ premixed formulas are engineered for direct application out of the pail. Modifying, thinning with excessive water, or intermixing third-party additives, unapproved pigments, or non-system sealants voids all technical support and product performance coverage.
5. Substrate Preparation & Installer Responsibility
Proper substrate preparation is critical to MyCROCEMENT™ performance. DIY Elevated LLC provides general application guides, video tutorials, and technical data sheets for educational purposes only.
- Substrate Integrity: The customer or installer is solely responsible for verifying that the underlying substrate (e.g., concrete, tile, drywall, cement board) is structurally sound, fully cured, clean, dry, free of hydrostatic pressure, and properly primed before MyCROCEMENT™ application.
- Moisture & Hydrostatic Pressure: MyCROCEMENT™ systems are decorative surface finishes and are not structural waterproofing membranes or hydrostatic barriers. Damp substrates or active water intrusion will cause adhesion failure, blistering, or delamination. Moisture testing (e.g., Calcium Chloride or Relative Humidity probe testing) must be conducted by the installer prior to application.
- Substrate Movement & Cracking: MyCROCEMENT™ cures to a flexible, high-density finish, but it cannot bridge active structural cracks or joint movements in the underlying subfloor or framing. Any movement in the underlying substrate may telegraph through to the surface as a crack.
- Mock-Up Requirement: We strongly recommend that installers and DIY users perform a 2 ft x 2 ft sample board or test patch using the complete system (primer, MyCROCEMENT™ base, finish coats, and topcoat sealant) prior to full-scale application to verify color, texture, and adhesion.
6. Ordering, Pricing, & Payment Processing
- Order Acceptance: Receipt of order confirmations does not signify our acceptance of an order or confirmation of an offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order quantity for any reason.
- Pricing Errors: Prices for our products listed on mycrocement.com are subject to change without notice. In the event a product is listed at an incorrect price due to a typographical or system error, DIY Elevated LLC reserves the right to cancel or refuse any orders placed at the incorrect price, regardless of whether the order has been confirmed and charged.
- Payment Processing & Third-Party Gateways: All payments placed through mycrocement.com are processed via Shopify Payments, Shop Pay, or authorized third-party gateways. Neither DIY Elevated LLC nor the Holding LLC stores or directly handles full credit card numbers on their servers. Payment processing is governed by Shopify’s Terms of Service and Privacy Policy. Custom-tinted color batches will not enter production until payment has cleared.
7. Shipping, Logistics, & Freight Policy
All shipping, parcel deliveries, and Less-Than-Truckload (LTL) freight logistics are dispatched from our facility in Northborough, MA 01532 and governed by our official Shipping & Delivery Policy, which is incorporated into these Terms by reference:
- Freight Deliveries: Heavy or bulk orders (>150 lbs) ship via LTL freight with Curbside Delivery. Drivers will drop the pallet at the curb or driveway end and will not move materials indoors, into garages, or onto job sites.
- Mandatory Delivery Inspection: The recipient must inspect all pallets and pails prior to signing the carrier’s Bill of Lading (BOL). Any physical damage, leaking pails, or missing items must be documented directly on the driver’s BOL before the driver leaves. Writing “Subject to Inspection” does not protect freight claims.
- 48-Hour Claim Window: All damage claims, short shipments, or incorrect items must be reported in writing to Support within 48 hours of delivery, accompanied by required photo/video evidence.
- Temperature Protection & Storage: Liquid MyCROCEMENT™ pails and sealants must be protected from freezing. Upon delivery, products must be stored indoors immediately between 50°F and 85°F (10°C to 29°C). Freezing voids all material warranties.
8. Returns, Cancellations, & Restocking Fees
Returns and order cancellations are handled in accordance with our Return Policy as outlined below:

9. Limitation of Liability, Warranty Disclaimer, & Platform Outages
- Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIY ELEVATED LLC AND THE HOLDING LLC PROVIDE ALL PRODUCTS, TECHNICAL GUIDANCE, AND SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- No Coverage for Labor or Incidental Costs: IN NO EVENT SHALL DIY ELEVATED LLC, THE HOLDING LLC, OR THEIR RESPECTIVE MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES—INCLUDING BUT NOT LIMITED TO LOST PROFITS, JOB-SITE DELAYS, DEMOLITION COSTS, RE-INSTALLATION LABOR COSTS, OR PROPERTY DAMAGE—ARISING FROM THE USE OR INABILITY TO USE OUR PRODUCTS.
- Maximum Liability Cap: THE TOTAL CUMULATIVE LIABILITY OF DIY ELEVATED LLC AND THE HOLDING LLC FOR ANY CLAIM, LOSS, OR DAMAGE ARISING OUT OF OR RELATED TO ANY PRODUCT PURCHASED SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID BY THE CUSTOMER FOR THE SPECIFIC MATERIAL GIVING RISE TO THE CLAIM.
- Platform Availability & Third-Party Technical Issues: Neither DIY Elevated LLC nor the Holding LLC warrants that access to mycrocement.com will be uninterrupted, timely, or error-free. We shall not be liable for any order delays, site downtime, checkout failures, or technical glitches originating from Shopify Inc. or integrated third-party applications.
10. Indemnification
You agree to defend, indemnify, and hold harmless DIY Elevated LLC, the Holding LLC, and their respective parent entities, subsidiaries, members, managers, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms of Service.
- Improper application, substrate preparation, or failure to follow technical safety guidelines for MyCROCEMENT™.
- Infringement of any intellectual property rights owned by the Holding LLC or third parties.
- Negligent or intentional acts on job sites or residential installations.
11. Governing Law & Dispute Resolution
- Governing Law: These Terms and any separate agreements under which we provide you products shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.
- Jurisdiction & Venue: Any legal action, suit, or proceeding arising out of or relating to these Terms, the intellectual property on mycrocement.com, or purchases made from DIY Elevated LLC shall be instituted exclusively in the state or federal courts located in Worcester County, Massachusetts, and you irrevocably consent to the personal jurisdiction of such courts.
