MyCROCEMENT™ Terms of Sale
Effective Date: August 12, 2026
These Terms of Sale (“Terms”) govern all purchases of MyCROCEMENT™ products made through mycrocement.com, shop.mycrocement.com, or any other authorized MyCROCEMENT™ sales channel operated by DIY ELEVATED LLC (“DIY ELEVATED,” “we,” “us,” or “our”).
By placing an order for MyCROCEMENT™ products, you acknowledge that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, you should not place an order.
1. Products
MyCROCEMENT™ products are premixed microcement products and related materials intended for use in accordance with the applicable product instructions, technical documentation, and other information provided by us.
Product descriptions, photographs, colors, dimensions, coverage estimates, and other specifications are provided for general informational purposes and may vary from actual products or results.
Colors may appear differently depending on lighting, display settings, application technique, surface conditions, and other factors. Product samples, photographs, and digital representations should not be considered an exact representation of the finished appearance.
You are responsible for determining whether a product is suitable for your particular project, surface, environment, and intended use.
2. Orders and Order Acceptance
Submitting an order constitutes an offer to purchase the selected products.
An order is not considered accepted until we confirm acceptance of the order.
We reserve the right to refuse, limit, or cancel any order for any lawful reason, including product availability, pricing or listing errors, suspected fraud or unauthorized activity, shipping restrictions, or other circumstances that may prevent us from fulfilling the order.
If we cancel an order after payment has been received, we will refund the amount paid for the canceled order.
3. Product Availability
Product availability is subject to change without notice.
If a product becomes unavailable after you place an order, we may contact you regarding available alternatives or cancel the affected portion of the order and issue an appropriate refund.
We do not guarantee that any particular product, color, size, or configuration will remain available indefinitely.
4. Pricing and Taxes
Prices displayed on our website are subject to change without notice.
The price charged for an order will generally be the price displayed at the time the order is submitted, except in cases involving an obvious pricing, listing, typographical, technical, or system error.
Applicable sales tax and other government-imposed charges may be added to your order where required by law.
You are responsible for any applicable taxes, duties, tariffs, brokerage fees, customs charges, or other governmental charges associated with an international shipment, where applicable.
5. Payment
Payment must be successfully authorized before an order can be processed and shipped.
We may use third-party payment processors and other service providers to process payments. Your payment information may be subject to the terms and privacy policies of those third-party providers.
We do not knowingly accept fraudulent or unauthorized payment methods.
6. Shipping and Delivery
Orders are shipped to the address provided at checkout.
You are responsible for providing an accurate and complete shipping address. We are not responsible for delays, additional charges, or delivery problems resulting from an incorrect or incomplete address provided by you.
Estimated shipping or delivery dates are estimates only and are not guaranteed unless expressly stated otherwise.
Shipping times may be affected by carrier delays, weather, holidays, supply issues, customs processing, or other circumstances outside our reasonable control.
Once an order has been transferred to the shipping carrier, carrier handling and delivery are subject to the carrier’s policies and procedures.

7. Inspection Upon Delivery
You should inspect your order promptly after delivery.
If a package appears visibly damaged, you should document the condition of the package and its contents with photographs and contact us as soon as reasonably possible.
If products are missing, damaged, defective, or incorrect, contact us promptly so that we can review the issue and determine the appropriate resolution.
8. Returns and Refunds
Returns, refunds, exchanges, and cancellations are governed by our Refund & Return Policy, which is incorporated into these Terms by reference.
Nothing in these Terms is intended to limit any rights that cannot lawfully be waived under applicable law.
9. Warranty
Any applicable product warranty is governed by our Warranty Policy, which is incorporated into these Terms by reference.
To the extent a product is covered by a written warranty, the warranty applies only under the conditions and limitations stated in that warranty.
Unless expressly provided in a written warranty, we do not guarantee that a product will be suitable for every particular project, surface, environment, application method, or intended use.
10. Proper Product Use and Application
MyCROCEMENT™ products must be used in accordance with the applicable product instructions, technical data sheets, safety information, application guides, and other manufacturer or supplier instructions provided with or for the products.
You are responsible for:
- determining whether the substrate and project conditions are suitable;
- properly preparing the surface;
- following applicable application instructions;
- using appropriate tools and equipment;
- observing required drying, curing, and recoat times;
- following applicable safety instructions;
- determining whether additional preparation, primer, sealers, or other materials are required; and
- ensuring that the completed installation is appropriate for the intended use and environment.
Coverage estimates are approximate and may vary based on substrate condition, surface porosity, application technique, installer experience, thickness, waste, number of coats, and other factors.
Actual coverage is not guaranteed.
11. No Guarantee of Installation Results
Microcement is a hand-applied finishing material, and the appearance and performance of the finished surface may be affected by substrate conditions, preparation, environmental conditions, application technique, product thickness, sanding, sealing, curing, and other factors.
Variation in texture, visual movement, shading, color, trowel marks, clouding, tonal variation, and other visual characteristics may occur.
Such characteristics may be inherent to the application of microcement and do not necessarily constitute a product defect.
We do not guarantee a particular aesthetic result or finished appearance.
12. Project Suitability
Before purchasing or applying a product, you should evaluate the intended application and confirm that the product is appropriate for the specific project.
For professional, commercial, wet-area, high-moisture, high-traffic, exterior, or otherwise demanding applications, appropriate preparation, installation procedures, sealing, curing, and maintenance are particularly important.
Where there is uncertainty regarding product suitability or installation requirements, you should obtain appropriate professional advice before proceeding.
13. Safety
Read and follow all applicable product labels, Safety Data Sheets (“SDS”), technical documentation, and application instructions before using any MyCROCEMENT™ product:
Use appropriate personal protective equipment and ventilation as recommended by the applicable product documentation.
Keep products away from children and use them only for their intended purpose.
Do not use any product in a manner inconsistent with its labeling, safety documentation, or applicable instructions.
14. Limitation of Liability
To the maximum extent permitted by applicable law, DIY ELEVATED LLC and its owners, officers, employees, agents, affiliates, suppliers, manufacturers, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the purchase, use, installation, inability to use, or performance of any product.
To the maximum extent permitted by applicable law, our total liability arising out of or relating to a particular purchase shall not exceed the amount actually paid by you for the product giving rise to the claim.
This limitation does not apply to liability that cannot lawfully be excluded or limited under applicable law.
15. Installation and Third-Party Services
DIY ELEVATED LLC sells products but does not, unless expressly agreed in writing, provide installation services.
If you hire a contractor, installer, designer, architect, builder, or other third party, that person or company is independently responsible for the services they provide.
We are not responsible for the acts, omissions, workmanship, recommendations, representations, or warranties of independent third parties.
16. Intellectual Property
MyCROCEMENT™, the MyCROCEMENT™ name and logo, product names, trademarks, trade dress, website content, photographs, graphics, written materials, technical materials, and other intellectual property associated with the brand are owned by or licensed to DIY ELEVATED LLC and are protected by applicable intellectual-property laws.
Nothing in these Terms grants you any ownership or other rights in our trademarks, copyrights, trade secrets, website content, proprietary product information, and other intellectual property except for the limited right to use purchased products for their intended purpose.
17. Website Information
We make reasonable efforts to provide accurate information on our website. However, website content may contain typographical errors, inaccuracies, omissions, outdated information, or other errors.
We reserve the right to correct errors and update website content, product information, pricing, availability, and other information at any time without prior notice.
18. Privacy
Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Privacy Policy is separate from these Terms and governs the handling of personal information associated with your use of our website and services.

20. Force Majeure
We are not responsible for delays or failures to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, labor disputes, transportation disruptions, supply-chain disruptions, governmental actions, utility failures, internet or technology failures, pandemics, or other events beyond our reasonable control.
21. Changes to These Terms
We may update these Terms from time to time.
The version of the Terms in effect at the time you place an order will generally govern that purchase, except where applicable law requires otherwise.
The current version will be made available on our website.
22. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.
Any dispute arising from or relating to these Terms or a purchase shall be subject to the jurisdiction of courts having proper jurisdiction, subject to any rights or requirements provided by applicable law.
23. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
24. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
25. Entire Agreement
These Terms, together with the policies and documents incorporated by reference, constitute the agreement between you and DIY ELEVATED LLC concerning your purchase of MyCROCEMENT™ products, except for any separate written agreement expressly entered into between you and DIY ELEVATED LLC.
